About these terms
These terms govern business-to-business wholesale supply of food-grade culinary nitrous oxide (E942) and related products by UK Cream Chargers Limited (Companies House registration 0820454), trading as Bulk Cream Chargers (“BCC”, “we”, “us”). Our registered office is 29 Looe Street, The Barbican, Plymouth, PL4 0EA, United Kingdom.
By submitting a wholesale enquiry, completing the qualification wizard, or accepting a proforma invoice, the buyer (“you”) agrees to these terms.
1. Wholesale-only supply
BCC supplies exclusively to qualified commercial buyers — distributors, retailers, foodservice operators, importers, wholesalers, and private-label brands. We do not sell to consumers. We reserve the right to refuse service to any applicant who is unable or unwilling to satisfy our qualification process (see Right to Refuse Service policy).
Products are supplied for commercial culinary, foodservice, resale, distribution, or private-label use only. Buyers must confirm intended legitimate use during qualification and on every order.
2. Qualification and Know Your Business (KYB)
Every buyer must complete our qualification process before a quote is issued. We may request:
- Registered company name, company number, and trading address
- VAT number (where applicable)
- Proof of foodservice / retail / distribution business activity
- Buyer authority confirmation (name, role, business email)
- Intended use confirmation
- Delivery destination and importer details where applicable
We reserve the right to decline applications without explanation and to require additional documentation at any stage.
3. Orders, quotes and proforma invoices
Quotes are valid for 14 days from issue unless otherwise stated. An order is binding only when the buyer remits the deposit specified on the proforma invoice.
Payment terms:
- UK buyers: 50% telegraphic transfer against proforma invoice; 50% balance on or before delivery.
- International buyers: 65% telegraphic transfer against proforma invoice; 20% against bill of lading and shipping documents; 15% on arrival.
Bank details are provided on the proforma invoice and are not published on the website.
4. Delivery
Delivery is door-to-door (DDP) where stated, with BCC acting as importer of record where applicable. Indicative timelines:
- UK: 7–10 business days
- EU: 14–28 business days
- Rest of world: up to 30 business days
Timelines are subject to qualification status, destination, documentation requirements, and current supply route. Exact dates are confirmed on the proforma invoice.
5. Title and risk
Title to goods passes to the buyer on full payment. Risk passes on delivery (DDP destinations) or on collection (Ex Works destinations) as specified on the proforma.
6. Returns and defects
Defects must be notified within 14 days of delivery with photographic evidence and the relevant batch number from the Certificate of Analysis. Approved defect claims are credited against the next order or refunded by telegraphic transfer at BCC’s discretion. Goods damaged after delivery, used, or stored outside the specified conditions are not eligible.
7. Limitation of liability
BCC’s aggregate liability under any order is limited to the invoice value of that order. We exclude liability for indirect, consequential, or commercial loss to the extent permitted by English law. Nothing in these terms limits liability for death, personal injury, or fraudulent misrepresentation.
8. Compliance and legitimate use
Buyers must comply with all applicable laws in their delivery jurisdiction. BCC supplies only for legitimate culinary, foodservice, resale, or private-label use and may suspend or terminate supply where there is reasonable suspicion of non-legitimate use.
Some jurisdictions restrict the supply or import of nitrous oxide products (for example, the Netherlands and Germany apply restrictions; the United States applies federal and state-level controls). The buyer is responsible for confirming legality in their destination. BCC reserves the right to decline any order based on destination compliance review.
9. Governing law and jurisdiction
These terms are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction over any dispute, except where applicable consumer protection or other mandatory law provides otherwise.
10. Changes to these terms
We may update these terms from time to time. The version in force on the date of order is the version that applies to that order.
